We, the RELEASERS, being of lawful age, indemnify, hold harmless and forever discharge Panamatura S.A., and its employees, directors and commercial partner of any responsibility for any injury, loss, damage, delay or death to person or property arising from negligent or willful act of failure to act of any person who is to or does provide goods or services for a trip or inaction of any other third party.
Without limitation Panamatura S.A. is not responsible for acts of God, equipment failures, vehicle accidents, illness from food or otherwise, assault, theft or criminal activity, annoyance, delays, quarantine, strikes, failure of any means of conveyance, and discrepancies or changes in transit or hotel services over which it has no control. Reasonable changes in the itinerary may be made here deemed advisable for the safety and well being of the clients. The right is reserved to substitute hotels or alter the itinerary.
We understand that the activities in which we will participate are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death.
We acknowledge, agree and represent that we understand the demands of adventure travel and tourism activities and that we are qualified, in good health and in proper physical conditions to participate in such activities. There will be no refunds for any reason. We also understand that in the event of an emergency evacuation, these will be realized by public emergency response authorities. In case you request private services it will be at your own cost and responsibility. We are also aware that our participation is not covered by any insurance issued by Panamatura S.A.
We grant permission to Panamatura S.A. to use pictures or videos where we might show up during the activity at its sole discretion.
This WAIVER AND RELEASE contains the entire agreement between the parties to this release and the terms of this release are contractual and not a mere recital.
WE HAVE READ AND UNDERSTAND THIS AGREEMENT, AND WE ARE AWARE THAT BY SIGNING THIS AGREEMENT, WE ARE WAIVING LEGAL RIGHTS THAT WE OR OUR HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND ASSIGNS MAY HAVE AGAINST THE RELEASEE(S).
